IMPORTANT: Please read through these terms of sales carefully. By accepting the sales and delivery of the products and services described and contained in Switch’s Invoice or any related documentation, the customer agrees to accept and be bounded by these terms and conditions of sale unless a separate agreement has been signed by the customer and Switch. Switch reserves the right, at its sole discretion, to change, modify, add or remove portions of the Terms & Conditions of sale, at any time.

Purchase Price & Stock Availability

Prices and stock availability listed on Switch’s website and it’s corresponding websites are subject to change without notice.

Switch will try its best to keep information accurate and up to date but errors will occur and Switch reserves the to make adjustments to pricing, products and service offerings for reasons including, but not limited to, changing market conditions, product discontinuation, product unavailability, manufacturer price changes and errors in advertisements.

All orders are subject to product availability and payment is due before shipment can be processed. Orders are not binding upon Switch until accepted by Switch. Terms of payment are within Switch’s sole discretion and invoices are due and payable within the time period specified on the invoice, measured from the date of invoice. Switch may invoice parts of an order separately.

Customer is responsible for, and will indemnify and hold Switch harmless from, any applicable sales, use or other taxes or federal, state or local fees or assessments associated with the order. Customer must claim any exemption from such taxes, fees or assessments at the time of purchase and provide the necessary supporting documentation. Any sales, use or other applicable tax or fees or assessments is based on the location to which the order is shipped. In the event of a payment default, Customer will be responsible for all of our costs of collection, including court costs, filing fees and attorney's fees.

Order Limitations and Acceptance

Switch reserves the right to reject any order a customer places with us. At our own discretion, Switch may limit quantities or cancel quantities purchased per person, per household or per order.

Customer’s receipt of an electronic or any form of order confirmation by Switch does not signify Switch’s acceptance of the customer’s order, it also does not constitute confirmation of Switch’s offer to sell. Switch reserves the rights at any time after the receipt of customer’s order to accept or decline the order for any reason.

Product Display and Colour Accuracy

Switch endeavors to display product images on its site to be as accurate as possible. Switch is unable to guarantee that the color the customer sees matches the actual product colour as the display of colour depends, in part, upon the monitor the customers are using.

Typographic, Photographic and Technical Errors

Switch strives to achieve 100% accuracy for all posted information whether in words or pictures throughout Switch’s website and corresponding materials, however occasionally errors and inaccuracies might occur. Should you encounter any inaccuracy or error in our website, please do inform Switch and we will rectify the problem swiftly.

Products and packaging depicted in Switch’s website may differ from stock available in hand during time of shipment. Switch reserves the right to substitute equivalent items.

If an error is made on Switch’s website, Switch may, at its discretion, refuse or cancel any orders placed at the incorrect price. If an order has been confirmed and charged to your credit card at an incorrect price, Switch reserves the right to immediately void the transaction or issue credit in the amount of the incorrect price.

Switch Point Card Membership

Customers are able to redeem points for purchasing goods on Switch’s web store. However terms and conditions for card usage and point collection are subject to the same terms as Switch’s physical retail outlets.

Shipping; Risk of Loss & Security Interest

Switch will arrange payment for shipping with the carrier, but costs incurred for shipment shall be borne by customers. Switch charges shipping and handling fees for every shipment, unless a special promotion or contract term provides otherwise; such cost includes the freight charged by the carrier, packaging, and handling, but does not necessarily equal a direct pass-through of such cost to the customer.

Title to items being purchased passes from Switch to purchaser at the time of shipping and risk of loss is upon Customer once we deliver the product to the courier service appointed. Delivery times are estimates only and we shall not be liable for delays. Customer takes on full liability for safety and validity of delivery address given to us at the time of purchase. Switch will not incur any forwarding costs on shipments. Switch shall not be responsible for damages or delays resulting from Acts of God, war, riot, seizure, terrorist activities, embargo, or other acts or events nothing within the reasonable control of Switch.

Damaged & Defective Products

All packages shipped from Switch are inspected prior to shipment. However, from time to time, damage during shipping may occur.

Any hidden or internal damage to any product must be reported to Switch within the first 24 hours or receiving the product. Please contact us at onlinestore@switch.com.my.

Please save the product, the shipping carton and all manufacturer packaging or labels included. Timely receipt of this information is necessary for Switch to file a damage claim if applicable. Failure to notify Switch of damage within this time period will be deemed an acceptance of the product.

Please take note that all products sold on Switch’s Online Store are non-refundable and is not entitled to any type of product exchange in Switch’s physical retail outlets.

Limited Manufacturer’s Warranty

Customer understands Switch is not the manufacturer of the products purchased by the Customer hereunder and the only warranties offered are those of the manufacturer, not Switch. In purchasing the products, Customer is relying on the manufacturer's specifications only and is not relying on any statements, specifications in brochures, photographs or other illustrations representing the products that may be provided by us. In connection with services, neither affiliates of Switch nor third party service providers are our agents and we have no obligation or liability arising from any services performed by or any warranty, if any, made by, such service providers.

Switch warrants that we good title to the hardware products we sell, and that we have proper authority to license the software products we distribute.

Switch does not warrant the performance or integrity of any Product, but merely passes through to the Customer whatever end-user warranty the manufacturers or software publishers provide with their respective products.

Consumer Responsibilities

It is the customer’s responsibility to ensure that any goods purchased by the customer is compatible with existing components within your system or with your device.

It is also the customer’s responsibility to ensure proper installation of our goods into your existing system or device.

Termination of Use

Switch may, in its sole discretion, terminate a customer’s account or customer’s use of Switch’s website at any time. Customers are deemed personally liable for any orders placed or changes incurred prior to termination. Switch reserves the right to change, suspend or discontinue any aspects of Switch’s website at any time without prior notice.
